Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by StayPeek, Inc. (“StayPeek,” “we,” “our,” or “us”).

By accessing or using StayPeek, you agree to be bound by these Terms.

By completing a payment or activating the service, you acknowledge and agree to these Terms.

1. Overview of Service

StayPeek is a B2B SaaS platform that enables hotels to provide curated, location-based local content experiences to their guests through a web-based interface.

The service may include:

  • a hotel onboarding and account system
  • a content curation and management interface
  • guest-facing experience pages accessible via links or QR codes

Curated content is refreshed on a monthly schedule (the 5th of each month, KST); see §8-A for details.

2. Eligibility

You must be at least 18 years old and authorized to act on behalf of a hotel or business to use StayPeek.

By using the service, you represent that:

  • you have authority to bind the hotel or organization
  • all information you provide is accurate

3. Account and Access

To use StayPeek, you may be required to:

  • provide business and contact information
  • complete a payment process
  • create or activate an account

You are responsible for:

  • maintaining the confidentiality of your account credentials
  • all activities under your account

4. Service Flow and Payment Structure

StayPeek operates under the following onboarding and subscription model:

A. Deposit Payment

To initiate service, a one-time deposit payment may be required.

This deposit enables:

  • setup of your hotel's StayPeek experience
  • preparation of a preview version

B. Preview Phase

After setup, you will be provided access to a preview version of your StayPeek experience.

During this phase, you may:

  • review the content and experience
  • decide whether to proceed

C. Approval and Activation

If you are satisfied with the preview, you may activate the service.

Upon activation:

  • you receive a free first month (30 days)
  • after the free period, a monthly subscription fee (e.g., $199/month) will be charged automatically

D. Subscription Billing

  • billing is recurring and automatic unless canceled
  • payments are processed via third-party providers such as Stripe
  • you are responsible for ensuring valid payment details

5. Refund Policy

A. Before Activation (Preview Stage)

If you are not satisfied with the preview:

  • you may request a full refund of the deposit
  • upon refund, your access to the service will be terminated

B. After Activation

Once the service is activated:

  • the free first month is non-refundable
  • subscription fees charged after the free period are non-refundable, except where required by law

6. Cancellation

You may cancel your subscription at any time.

  • cancellation will take effect at the end of the current billing cycle
  • no partial refunds are provided for unused time

7. Use of Service

You agree not to, and will not permit any third party to:

  • Decompile, reverse engineer, disassemble, or otherwise attempt to derive the source code, underlying ideas, or algorithms of the Service.
  • Use any robot, spider, scraper, or other automated means to access the Service for any purpose, including data scraping, crawling, or data mining.
  • Access or use the Service in order to build a competitive product or service.
  • Bypass, circumvention, or attempt to bypass any measures we may use to prevent or restrict access to the Service.
  • Upload any image or other content that infringes third-party copyright, trademark, or publicity rights, including photographs sourced from the internet, stock image sites, or other hotels without a valid license.
  • Upload images depicting identifiable individuals (including guests, staff, or passersby) without their prior, informed consent, or any images of minors.

7-A. User Content and License

As a hotel customer, you may upload images and other content (“User Content”) to StayPeek in order to configure your guest-facing experience.

By uploading User Content, you represent and warrant that:

  • you own the User Content or have obtained all rights, licenses, consents, and permissions necessary to use it and to grant the license below;
  • the User Content does not infringe any third party's intellectual property, privacy, publicity, or other rights;
  • the User Content does not contain images of identifiable individuals without their prior consent, and does not depict minors;
  • the User Content complies with all applicable laws and does not contain unlawful, defamatory, obscene, or otherwise objectionable material.

You grant StayPeek a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute your User Content solely for the purpose of operating, providing, and improving the Service (including display on guest-facing experience pages). This license ends when you delete the User Content or terminate your account, except to the extent retention is required for legal, backup, or security purposes.

StayPeek reserves the right, but is not obligated, to review, remove, or disable any User Content that we reasonably believe violates these Terms or applicable law.

7-B. Copyright and DMCA Policy

StayPeek respects the intellectual property rights of others and expects users to do the same. If you believe that content hosted on StayPeek infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (“DMCA”).

A DMCA notice should include:

  • an electronic or physical signature of the copyright owner or authorized agent;
  • identification of the copyrighted work claimed to have been infringed;
  • identification of the allegedly infringing material and its location on StayPeek (e.g., URL);
  • your contact information (address, telephone number, email);
  • a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

StayPeek may, in appropriate circumstances, remove or disable access to allegedly infringing content and terminate the accounts of repeat infringers.

7-C. Hotel-Provided Information Accuracy

Hotels using StayPeek are solely responsible for the accuracy of information they provide, including but not limited to hotel name, address, contact details, photos, logos, and descriptive content. StayPeek does not independently verify hotel-supplied data. Guests viewing a hotel's experience page should not assume StayPeek has validated such information.

8. Third-Party Content and Services

StayPeek may display or integrate content from third-party platforms such as YouTube and mapping services.

  • such content is subject to the terms of those platforms
  • StayPeek does not own or control third-party content

StayPeek uses these services in compliance with applicable platform policies.

External services on which StayPeek depends — including but not limited to YouTube, Google Maps Platform, and analytics providers — may unilaterally modify their APIs, content policies, embedding rules, quotas, or terms at any time. As a result, certain videos may become un-embeddable, place metadata may become incomplete, and individual features may be temporarily or permanently degraded without prior notice. StayPeek will use commercially reasonable efforts to adapt but disclaims liability for service degradation caused by upstream third-party changes.

8-A. Content Update Schedule and Time-Sensitive Information

StayPeek aggregates location-based content (videos, business names, addresses, photos, business status) from third-party sources on a monthly cycle, on the 5th of each month (KST), through an automated synchronization job.

Because updates are scheduled rather than real-time, displayed information — including business operating hours, temporary closures, menus, contact details, and other time-sensitive attributes — may be outdated by up to approximately 30 days at any given moment.

Guests are responsible for verifying current business hours, availability, and operating status directly with the establishment before visiting. StayPeek does not guarantee the accuracy or timeliness of such information and shall not be liable for any loss, damage, inconvenience, or wasted travel resulting from reliance on it.

9. Intellectual Property

All rights, title, and interest in StayPeek, including software, design, and content (excluding third-party content), remain the property of StayPeek, Inc.

You are granted a limited, non-exclusive, non-transferable license to use the service.

10. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted or error-free operation.

StayPeek may:

  • modify features
  • suspend or discontinue parts of the service

10-A. Force Majeure

StayPeek shall not be liable for any failure, delay, or interruption of the service caused by events beyond its reasonable control, including but not limited to natural disasters, war, civil unrest, government action, labor disputes, internet or telecommunications outages, failures of cloud infrastructure or third-party services, cyberattacks, or pandemics.

11. Disclaimer of Warranties

StayPeek is provided “as is” and “as available.”

We make no warranties regarding:

  • accuracy of content
  • availability
  • fitness for a particular purpose

12. Limitation of Liability

To the maximum extent permitted by law:

StayPeek shall not be liable for:

  • indirect, incidental, or consequential damages
  • loss of revenue, profits, or data

Our total liability shall not exceed the amount paid by you in the preceding 3 months.

13. Indemnification

You agree to indemnify and hold harmless StayPeek from any claims arising from:

  • your use of the service
  • violation of these Terms
  • infringement of third-party rights

14. Privacy

Your use of the service is also governed by our Privacy & Cookies Policy.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

16. Changes to Terms

We may update these Terms from time to time.

Continued use of the service after changes constitutes acceptance of the updated Terms.

17-A. Guest Experience Page (GEP) — Viewer Terms

The Guest Experience Page (GEP) is a viewer-only interface provided by StayPeek on behalf of subscribing hotels for the convenience of their guests. Guests accessing a GEP are not parties to the contractual relationship between StayPeek and the hotel, but their use is nevertheless subject to the disclaimers and limitations of liability set forth in §8, §8-A, §10, §10-A, §11, and §12. Decisions to visit, contact, or transact with any business featured in GEP content are made entirely at the guest's own discretion and risk.
